Objectives of the assignment

The UN JPLG is a 5 year joint programme of ILO, UNCDF, UNDP, UN-HABITAT and UNICEF. The partners in the Joint Programme are the District Councils and associated Government structure. The Programme is aligned to the programming frameworks of the Somaliland Reconstruction and Development Programme (RDP) 2008-12 and the UN Transition Plan (UNTP) 2008-10. The outcome of the RDP is to achieve decentralized service delivery in all of Somaliland. The outcome of the UNTP is that local governance contributes to peace and equitable priority service delivery in selected locations.

It is envisaged to achieve as wide coverage in Somaliland as resources and conditions allow with a comprehensive approach to assist local governments to be credible, professional service providers, increasing public investment in basic services, and strengthening civic awareness and participation in local decision-making and development. The strategy pursued will comprise:
(i) policy and legal frameworks for decentralization, local government, service provision and land management,
(ii) institutionalizing local government systems, vertical and horizontal inter-government linkages and civic education initiatives,
(iii) investment in public services and goods through testing a Local Development Fund model, direct service provision and promotion of public-private partnerships, and
(iv) processes and systems for housing, land and property disputes and resolution.

UNDP’s interventions as part of the joint programme will be derived from its current local governance projects, but will also comprise a growing involvement in local finance, notably through the implementation of the District Basket Fund. These interventions can be summarized as follows:

1. Support the strengthening of local governance structures and capacity development.
2. Provide support to the establishment and functioning of district councils, including through the rehabilitation and equipment of district and regional councils premises, building the awareness of the district councils of their mandate, duties and responsibilities, and building their operational, administrative and financial management capacity;
3. Support the delivery of services at local level financed from a district basket fund managed by the district councils and implemented through a participatory planning process.
4. Assist authorities in improving legislation related to local governance, decentralization, and fiscal transfer mechanisms, and in building the long-term capacity of local public servants.

Objective:

The objective of this assignment is to assess the current systems of service delivery at the sub national level in all three areas of Somalia with an initial priority in Somaliland and Puntland and make recommendations to increase the effectiveness and efficiency of service delivery through more efficient institutions.

Purpose:

• Building on the existing institutional assessments and legal frameworks, review the on the ground reality of the sub national administrations in terms of the structure, accountabilities, functions and service delivery mechanisms.
• Based on best practice, identify options to optimize the role that the district and regional authorities carry out in the local governance structure to ensure the promotion of service delivery and to provide a foundation of a local government policy and legal framework that prioritizes service delivery.
• Identify options for re-structuring the system at the sub national level to address the issues emerging from the above assessment.
• Develop a capacity development strategy and road map for the respective Ministries of Interior (MOI) based on the existing institutional assessments, capacity development assessments and interviews.

Functions / Key Results Expected

The tasks of the consultant is:

Under the overall guidance of UNDP/JPLG and in close collaboration and with extensive participation from the Puntland and Somaliland Interior Ministries and sub national administrations:
• Perform an analysis of the subnational administrations (in cooperation with its management and heads of departments as well as key people in each department identified by the Director General MOI, Regional Governor, DC Executive Secretary and Mayors), through the review of current documents, internal structure and list of functions and personnel, and submit concrete recommendations for the improvement of the respective institution’s general mandate, structure, service provision, accountability and oversight, management process, working relationships, and distribution of the tasks in the short and medium term.
• Undertake and facilitate interviews and discussions with the central and regional authorities.
• Develop options and recommendations for a capacity development strategy and road map for MOI (in south central, Puntland and Somaliland) based on the existing institutional assessments, capacity development assessments and interviews that include concrete implementation strategies.

The scope of work is as follows:

• Study relevant legal framework, policies, strategies, capacity development assessments, service delivery practice, and discuss with key stakeholders and beneficiaries of service delivery to enable an analysis of the context.
• Based on these documents, resources, discussions, and analysis, verify and present an organizational chart and list of functions of each department for:
o The District council of Benadir
o The District councils and administrations in Puntland
o The District councils and administrations in Somaliland
• Identify the main options in each department for:
o Roles and responsibilities
o Functions
o Staffing
o Management processes
o Service provision
o Working relationships
o Participation
o Accountability structures
• Using the existing institutional assessments and capacity assessments and taking into account current resources, develop a capacity development strategy and roadmap for MOI in Puntland, Somaliland and South Central with concrete milestones and implementation procedures to increase the capacity of the organizations to fulfill their mandates.

Deliverables:

• Inception Report outlining the understanding of the TOR, methodology to be applied for collection of information, key interviews, target districts to visit, a detailed work plan, and list of content for the report. The Inception Report shall be delivered no later than 10 days after the start of the assignment.
• Debriefing sessions with the key findings to be conducted with key stakeholders in Hargeisa and Garowe at the completion of the field mission, and in Nairobi for the Ministry of Interior – TFG at the end of mission. A power point presentation shall be completed for review prior to the debriefing sessions.
• Draft reports on service delivery of the subnational administrations in each area to be delivered which shall contain an executive summary with key findings and recommendations; a contextual analysis; methodology applied for functional analysis; overall findings, observations and prioritized recommendations; timeline and scope of work for implementation of the recommendations. The list of attachment shall include but not be limited to: list of people met; mission schedule; list of documents reviewed; key responses at the debriefing sessions. The draft report shall be delivered no later than 35 working days after the start of the assignment
• Draft reports on the capacity development strategy options in each area and possible options of a capacity development roadmap for MOI with an executive summary of the key findings and recommendations based on the existing reports and interviews made; and a timeline and roadmap for the implementation of the recommendations.
• Final reports to be delivered no later than 50 working days after the start of the assignment.

Impact of Results

As the consultancy will help establish options for the structure, functions and relationships of the District Councils, the impact of the consultancy should be an improved service delivery mechanism of the district councils once the recommendations have been decided and acted upon. The consultancy will also set out a concrete road map for capacity development interventions with the Ministry of Interior and thus also an improved functioning of MOI will be achieved.

V. Qualifications and Competencies

• Master’s Degree in development studies, social studies or any other relevant field.
• A minimum of 10 years experience in capacity or organizational development of central and local government institutions required.
• Demonstrated experience working with local government institutional analysis, local government policies, and public administration reform
• Team leader experience and demonstrated strong analytical skills required.
• Experience from working in a conflict setting a strong advantage.
• Innovative, solution oriented, and a positive attitude required.
